    IMPORTANT: These Terms contain information about our use of artificial intelligence (AI) technology as part of our challenges. Please read Section 3 carefully before joining.

    1. Introduction and Definitions

    These Terms and Conditions (“Terms”) govern the provision of guided creative challenges (“Services”) by Your AI Assistant, trading as Heart to Art (“we”, “us”, “our”, “the Company”). Our registered address is 10 Greville Avenue, Croydon CR2 8NL.

    By joining a Challenge, you (“the Customer”, “you”, “your”) agree to be bound by these Terms. Please read them carefully before you pay.

    Key Definitions

    “Customer” means the individual who pays for and joins a Challenge.

    “Challenge” means one of our named guided programmes (currently: The Family Quiz Night, The Wedding Speech, The Personalised Song, The Children’s Book, The Life Story, and The Musical).

    “Subject” means the person a Challenge is about. This may be the Customer themselves (for example, in The Life Story), or another person — living or deceased — that the Customer is writing about (for example, in The Personalised Song or The Children’s Book).

    “Group” or “Cohort” means the set of Customers who start a Challenge together on the same start date.

    “Materials” means the Creative Journal, Prompt Library, lesson emails, lesson videos, live calls, and any other content we provide as part of a Challenge.

    2. Our Services

    Heart to Art runs guided creative challenges that help people create a real, finished piece — a song, a speech, a book, their own life story, or a musical — over a set number of days, using the Heart to Art Method.

    2.1 What’s Included

    For every Challenge, our Services include:

    • Daily guided lessons, delivered one at a time over the length of the Challenge.
    • The Creative Journal for that Challenge.
    • Ready-to-use prompts for use with third-party AI tools.
    • A live kickoff call, for Challenges where one is offered (recorded for anyone who can’t attend live).
    • The Prompt Library, yours to keep after the Challenge ends.

    2.2 Groups and Cohorts

    Some Challenges run on a fixed start date with a Group. Where a Challenge is described as “by invitation” or “by application” (currently The Life Story and The Musical), joining is subject to our acceptance.

    3. How Challenges Use AI Technology

    3.1 AI-Assisted Learning

    We believe in full transparency about how our Challenges work. You do the creating — the Method and our guidance help you do it well. Specifically:

    • We provide ready-to-use prompts for AI language tools (including services provided by Anthropic and OpenAI) to help you shape your own words.
    • Where a Challenge involves music (currently The Personalised Song and The Musical), we guide you in using AI music generation technology (Suno AI) to produce the musical elements yourself.
    • Our lessons and Materials are reviewed and quality-assured by our human team.

    3.2 How Your Information Is Used in AI Tools

    When you enter stories and personal details into the AI tools we recommend as part of a Challenge, that information is processed directly by the following third-party platforms — not by us:

    • Anthropic (Claude) — a US-based AI company. Their API terms state that customer inputs are not used to train their models.
    • OpenAI (ChatGPT) — a US-based AI company. Their API terms state that customer inputs are not used to train their models by default.
    • Suno AI — a US-based AI music generation company.

    Because you use these tools directly (rather than us processing your stories on your behalf), you are responsible for what you choose to type into them. Our guidance will always tell you what kind of information is useful to include.

    3.3 Important Acknowledgements

    By joining a Challenge, you acknowledge and agree that:

    • AI technology is a tool you will use yourself, guided by our lessons and prompts.
    • Personal stories and details you choose to enter into these tools will be processed by third-party AI platforms based in the United States.
    • AI-generated content may occasionally produce unexpected or imperfect results, and part of what we teach is how to work with that.
    • You have read and understood this Section 3 and consent to the use of AI technology as part of your Challenge.

    4. Information About Other People

    Most Challenges involve writing about someone else — a partner, a grandchild, a parent, or a friend. This section explains your responsibilities.

    4.1 Living Subjects

    Where a Challenge is about a living person other than you, the stories and personal details you share (including into the AI tools we recommend) constitute their personal data under UK GDPR. By providing this information, you confirm that:

    • You have the authority to use these personal details for the purpose of your Challenge.
    • You have informed the Subject, or will inform them, that their personal information is being used as part of a creative project involving AI tools, or — where the piece is intended as a surprise — you accept responsibility for informing them once it’s appropriate to do so.
    • If the Subject objects to the use of their personal information, you will let us know, and we will take reasonable steps to help you address their concerns.

    4.2 Children (The Children’s Book challenge)

    Where a Challenge involves a child’s name, appearance, or personal details — in particular, The Children’s Book — you confirm that you are the child’s parent or legal guardian, or have their parent or guardian’s clear permission to use this information for the purpose of the Challenge.

    4.3 People Who Have Died

    Some Challenges (in particular, The Life Story) may involve memories of someone who has died. Information about a deceased person is not protected by UK data protection law, but stories about them may incidentally contain personal information about living people — see 4.1 above.

    5. Orders and Pricing

    5.1 Placing an Order

    Orders are placed directly by the Customer. All orders are subject to acceptance by us, and — for Challenges run “by invitation” or “by application” — subject to a place being available.

    5.2 Price

    Current prices for each Challenge are shown at heart-to-art.co.uk. Some Challenges are offered at a founding or introductory price for their first Group, rising to a standard price for later Groups. Joining at a founding or introductory price does not entitle you to that price for any later Challenge. VAT is not currently chargeable, but may be in the future.

    We reserve the right to change our prices at any time. Price changes will not affect orders already accepted.

    5.3 Payment

    Payment is required in full before access to a Challenge’s Materials begins. Payment is processed securely by Stripe via our GoHighLevel platform. We do not store or have access to your full card details.

    6. Delivery and Access

    Challenges with a fixed start date begin delivering Materials from that date. Materials are delivered electronically, by email and through our online platform. There is nothing to install.

    Where you join a Challenge close to its start date, you may receive some introductory Materials in a shorter window than other Customers in the same Group.

    7. Your Cancellation Rights

    7.1 Consumer Cancellation Rights

    Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer ordering at a distance, you have a 14-day cooling-off period during which you may cancel for a full refund.

    7.2 Waiver of Cancellation Rights for Digital Content

    Because our Challenges are delivered as digital content, if you ask us to give you access before the 14-day cooling-off period ends, you must expressly consent to this at checkout and acknowledge that you will lose your right to cancel under Section 7.1 once all the Materials for your Challenge have been delivered to you.

    7.3 Our Guarantee

    Separately from your statutory cancellation rights above, we offer this guarantee on every Challenge: finish the Challenge and love what you’ve made, or your money back. You have a full 30 days from your Challenge’s start date to ask for a refund under this guarantee.

    8. Intellectual Property

    8.1 What You Own

    Unlike a bespoke commission, in a Heart to Art Challenge you do the creating. The finished piece you make during your Challenge — your song, your speech, your book, your life story — belongs to you.

    This is subject to the terms of any third-party tool you use to make it. For example, Suno AI’s own terms govern commercial use rights for anything generated through Suno, and ChatGPT and Claude have their own terms for content generated through those platforms. We recommend reviewing the relevant platform’s terms before any commercial use of your finished piece.

    8.2 What We Own

    Copyright in the Materials we provide — the Creative Journal, the Prompt Library, lesson content, and the Heart to Art Method itself — belongs to Your AI Assistant.

    Upon payment, we grant you a personal, non-exclusive, non-transferable licence to use the Materials for the purpose of completing your own Challenge. You may not resell, redistribute, publish, or teach from our Materials, or use them to run your own course or challenge, without our prior written consent.

    9. Other Services

    If you’d like your finished piece professionally produced and released — for example, a fully produced and mastered version of a song you’ve written — Made for You Music offers a complete done-for-you service. This is a separate service with its own terms, available at madeforyoumusic.co.uk.

    10. Our Technology Platform

    In addition to the AI tools described in Section 3, we use the following platforms:

    • GoHighLevel — our website, CRM, course delivery, and payments platform.
    • Stripe — our payment processor.

    11. Data Protection

    We take the protection of personal data seriously. Full details are in our Privacy Policy, which forms part of these Terms.

    By joining a Challenge, you confirm that you have read our Privacy Policy and that, where you are providing personal information about another person, you have complied with your responsibilities under Section 4 of these Terms.

    12. Limitation of Liability

    12.1 Our Liability to You

    Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by English law.

    Subject to the above, our total aggregate liability shall not exceed the total amount you paid for your Challenge.

    We shall not be liable for indirect, consequential, special, or incidental losses.

    12.2 AI-Related Limitations

    We cannot guarantee the output of any third-party AI tool, or that your finished piece will precisely match your expectations. Our liability in relation to your use of AI tools as part of a Challenge is limited to using reasonable skill and care in the guidance we provide.

    12.3 Events Beyond Our Control

    We shall not be liable for failure or delay caused by circumstances beyond our reasonable control, including third-party platform failures, internet outages, or force majeure events.

    14. General Terms

    • Governing Law: These Terms are governed by the laws of England and Wales.
    • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between us.
    • Severability: If any provision is found invalid, the rest continues to apply.
    • Amendments: We may amend these Terms. The current version will always be on our website. We will notify Customers with an active Challenge of material changes.
    • No Waiver: Failure to exercise a right does not waive it.
    • Assignment: You may not assign these Terms without our consent. We may assign them provided it does not adversely affect your rights.
